General Terms of Sale (GTS)

The General Terms of Sale govern all orders on our website. They outline your rights and obligations, as well as those of EB WINE, ensuring a clear and secure commercial relationship.

1. General

Scope

EB WINE (hereinafter the "Seller" or "EB WINE"), whose contact details are indicated in the Legal Notice section, offers an e-commerce service accessible at https://ebwine.com/, intended for customers: anyone visiting or making a purchase.

Acceptance of Terms & Conditions

All orders placed on the Site are governed by these terms and conditions of sale (T&Cs). They take precedence over any other document issued by EB WINE, such as brochures, catalogs, or emails. By using the Site or placing an order, the Customer acknowledges having read and accepted these T&Cs.

Validity

EB WINE may modify the T&Cs at any time; the terms in effect at the time of the order will apply. Failure to immediately enforce any provision of the T&Cs does not constitute a waiver.

2. Products

Product Description

EB WINE takes great care in presenting and describing the Products offered (website, phone, or email), notably via the product sheet including photos and essential characteristics. Photographs and evaluations are provided for reference only and have no contractual value. The Customer must refer exclusively to the product sheet, which is the sole source of contractual information. EB WINE reserves the right to update or supplement it at any time.

Product Availability

Products are offered for sale while stocks last. EB WINE reserves the right to limit ordered quantities and to update its catalog at any time. In case of delay or unavailability after an order, EB WINE will inform the Customer and may propose cancellation with a refund, delayed delivery, or a product of equivalent quality and price. In case of permanent unavailability, the Customer will be refunded within a maximum of fourteen days using the same payment method as the original order.

3. Orders

Ordering Process

The Customer can place orders on the Site by adding desired Products to their shopping cart, which can be viewed and modified at any time before confirmation. The order is finalized after entering contact information, choosing the delivery method, accepting these T&Cs, and confirming secure payment. Orders can also be placed by phone or email, following the validation of a quote sent by EB WINE and accepted by the Customer.

Minimum Order and Legal Age

The minimum purchase amount required to validate an order is set at €30 including taxes. By placing an order on the site, the user declares being of legal drinking age in their country of residence and agrees to comply with applicable laws.

Order Confirmation

After placing an order and completing online payment, the Customer receives a confirmation email along with the invoice. If the Customer chooses payment by bank transfer, an email will be sent inviting them to complete payment to validate the order definitively.

Order Refusal and Cancellation

EB WINE may refuse any order if the quantity or frequency seems suspicious. In case of partial or total unavailability after an order, EB WINE will offer a refund within 14 days after cancellation confirmation (in accordance with consumer law) or propose, in agreement with the Customer, an equivalent product.

4. Prices and Payment Terms

Prices

Prices displayed on the Site are in euros, all taxes included (VAT), excluding delivery costs. The applicable VAT is the rate in effect in France or abroad on the order date. Prices applicable are those shown on the Site when the Customer confirms the order. EB WINE reserves the right to modify its prices at any time; new prices apply immediately upon posting. Occasionally, pricing errors may occur. In such cases, a verification is performed before shipping the order. If the corrected price is higher than initially displayed, we will inform you before shipment. You can then accept the order at the new price or request its cancellation.

Payment Methods

Full payment of the order is required at the time of validation. Accepted payment methods on our bank account domiciled in France are:

  • Credit card (Carte Bleue, Visa, Mastercard, American Express). All transactions on our site are 100% secure via PrestaShop Checkout. Your banking information is encrypted and transmitted directly to your bank through a secure SSL connection. We never store your payment data.
  • Paypal
  • Bank transfer: details are provided during and after the order via email. Any bank fees related to the transfer are borne by the Customer. In case of partial payment, the remaining balance must be paid to validate the order.

No payment deferral is possible without prior agreement. Checks are not accepted.

5. Delivery / Insurance / In-store Pickup

1. Deliveries

Delivery in mainland France is ensured within 4 to 8 business days after payment. Orders over €500 including tax benefit from free delivery; orders below €500 are subject to shipping fees.

In case of high temperatures, the Customer may proceed with delivery or request, in the order comments, to postpone shipping to a more favorable climatic period (highly recommended). By choosing to maintain delivery during heatwaves, the Customer assumes full responsibility for any quality alterations caused by temperature fluctuations during transport. No claims can be made against EB WINE in this regard.

Upon receipt, the Customer must check the condition and contents of the package. In case of damaged product(s), the Customer must notify us within 24 hours by email at: info@ebwine.com. Photos of damaged products will be requested to arrange replacement or refund. After 24 hours, claims cannot be considered.

2. Shipping & Insurance Costs

Shipping costs include:

  • Order preparation
  • Secure packaging suitable for bottles
  • Insurance covering bottles until delivery
  • Delivery fees

3. In-store Pickup

Products can be picked up for free, upon presentation of the Customer's ID (or a proxy), at our store by appointment at: 5 Route de la Madeleine, THEIXA'PARK - N°30, 56450 THEIX-NOYALO.

In case of non-pickup:
1. Pickup period: The Customer has 1 month to collect the order.
2. After expiration:
  • If the Customer still does not pick up after multiple reminders, the store reserves the right to cancel the order.
  • Products may be returned to stock.
  • Storage fees of €0.50/product per month will be deducted from the refund.
3. Recommended contact:
To avoid issues, the Customer is advised to contact Customer Service to schedule a new pickup or inform of a delay.

6. Retention of Title

Until full payment is made, EB WINE remains the owner of the goods. However, transfer of possession to the Customer constitutes transfer of risk: from delivery, the Customer is responsible for any damage, loss, or deterioration, even if full payment has not been made. Full ownership will be acquired only after complete payment.

7. Right of Withdrawal

The Customer has fourteen days from receipt to exercise the right of withdrawal, without justification or penalty. The request must be sent to EB WINE by email (info@ebwine.com) or mail. Products must be returned, at the Customer’s expense, within 14 days, in perfect condition and original packaging. Under Article L221-24 of the French Consumer Code, EB WINE will refund the product(s) price and initial delivery fees via bank transfer, free of charge for the Customer. Return costs are borne by the Customer.

EB WINE may refuse refunds if product depreciation results from handling other than necessary to check nature, characteristics, or good condition. EB WINE is not responsible for misuse by the Customer after delivery. Only Products returned in perfect condition and resalable state will be accepted. Opened, incomplete, damaged, or defective Products will not be refunded or exchanged.

8. Liability

EB WINE is not responsible for indirect, intangible, or unforeseeable damages, nor for Site unavailability. Liability is limited to direct, foreseeable damages resulting from order execution. EB WINE is not liable for force majeure events such as strikes, bad weather, natural disasters, fire, IT failures, carrier delays, or damage due to improper storage or consumption of products by the Customer.

9. Amicable Dispute Resolution

In case of dispute, the Customer is invited to contact Customer Service to find an amicable solution. If no solution is found within two months, the Customer may refer the case to an accredited consumer mediator, such as the Association de Médiateurs Bretagne Ouest (AMBO): https://www.ambo.bzh/. These T&Cs are governed by French law. In judicial disputes, the competent court is that of the consumer's domicile or, failing that, as per French legal rules.

10. Minors and Health Warning

In France, alcohol sales are prohibited to persons under 18. Alcohol abuse is dangerous to health and should be consumed responsibly.

11. Visuals

Photographs are provided for reference only and have no contractual value. The Customer must refer to the product sheets.

12. Intellectual Property

The Site content, including texts, images, logos, and databases, is protected by copyright. Any reproduction or use without authorization is prohibited.
